Mylan Inc., a U. S. drugmaker, has agreed to pay $2.3 billion to settle lawsuits over alleged drug companies failed to warn consumers about the potential side effects of the drug. The company is seeking to settle those claims in a $4.5 billion settlement of suits filed by consumers, doctors, insurers and others against the makers of Zyprexa.
Mylan has agreed to settle all of its lawsuits in the U. involving the company's alleged "medication side effects," a drug that had been used by more than a quarter of people diagnosed with schizophrenia and bipolar disorder. The lawsuits were brought in the U. District Court in Los Angeles and the U. Court of Appeals for the Fourth Circuit in New York. On behalf of the plaintiffs, Mylan is a defendant in several of the lawsuits.
"We are disappointed that these cases have been transferred," said Michael B. Klee, a spokesman for Eli Lilly & Co., a drug company that manufactures the company's generic version of Zyprexa. "The settlement will be a milestone in the overall litigation process."
Mylan was formed to provide a safe and effective alternative to the antipsychotic drug Zyprexa, which had been available for nearly 20 years to treat the symptoms of schizophrenia and bipolar disorder. Mylan was the company's first pharmaceutical company to file a generic version of the drug.
"Zyprexa was initially developed as an antidepressant, but its effects on brain chemistry were later discovered to be similar to those of the blockbuster antidepressant Prozac," said James M. O’Connor, a spokesman for Eli Lilly, which manufactures the drug.
The Zyprexa lawsuits were filed under seal by the company in June and July 2011, and they are based on data from the Food and Drug Administration's (FDA) analysis of the data from the studies in the lawsuits. The FDA's analysis found that the company had failed to warn the public about the drug's side effects. The FDA did not recommend that the company be given more than a three-month window before the drug was approved for sale, but had only allowed for one-month trials.
Mylan also faces a class-action lawsuit filed by plaintiffs in the class action, alleging that the company's failure to adequately warn consumers of the potential side effects led to the company's failure to adequately warn consumers about the drug's potential risks. WASHINGTON --In her early career, Zyprexa was touted as a drug to treat schizophrenia, but critics argued that the drug was not as effective as Zyprexa, which was often prescribed for bipolar disorder.
Now, researchers have found that the drug is superior to what Zyprexa is already approved by the U. S. Food and Drug Administration to treat schizophrenia and bipolar disorder.
This study, published in the February issue of the journal, "Journal of the American Academy of Psychiatry and the Sciences," is the first to link the drug to its "major benefit" -- Zyprexa.
"We found that the combination of the medication and a placebo significantly outperformed the combination of a placebo and a different type of drug," said Dr. David E. Ricks, the lead author of the study.
In its article, published in the February issue of the journal, Ricks and co-authors stated that the drug's effect on symptoms was "significantly different from placebo effect" that is believed to be due to the drug's ability to "cause the person's mood to stabilize," "especially for patients who experience an increase in the number of psychotic symptoms."
Ricks and his colleagues believe that a placebo is a better choice to treat people with schizophrenia, and they found that "the combination of these two drugs, in addition to the typical psychotropic drug, is superior to the combination of the other two drugs."
Ricks said that in the past, the drug has been used to treat schizophrenia and bipolar disorder but is often used for other uses, including other conditions where an agent is needed to treat bipolar disorder. He said this study will be important in developing more effective medications for these uses.
Ricks also said that Zyprexa's effectiveness is "significant for patients and clinicians," which is true for all patients with schizophrenia and bipolar disorder, including those who have been prescribed the drug.
"We need more than that," he said. "It's really important that we get the information that the drug is safe and effective in the early stages of treatment."
